Terms of Service
Effective Date: August 20, 2026. These terms govern your access to and use of 38Apex Technologies engineering services, web platforms, and digital solutions.
1. Engineering Services & Deliverables
38Apex Technologies delivers enterprise web development, custom ERP software, cloud microservices, and AI-driven platforms. All client engagements are subject to executed Statement of Work (SOW) agreements outlining milestones, acceptance criteria, and delivery timelines.
2. Intellectual Property Rights
Upon full payment of project fees, proprietary codebases and custom software assets built specifically for the client are assigned to the client as specified in the SOW. 38Apex Technologies retains ownership of pre-existing core frameworks, developer utilities, and reusable system design architecture.
3. Acceptable Use & Security Compliance
Users of our platform, admin portals, and contact systems agree not to:
- Attempt path traversal, unauthorized database access, or reverse engineering of software binaries.
- Submit malicious executables, automated bot spam, or content violating third-party IP rights.
- Bypass rate limiters, web application firewalls, or authentication headers.
4. Limitation of Liability
To the maximum extent permitted by applicable law, 38Apex Technologies shall not be liable for indirect, incidental, consequential, or punitive damages arising from temporary service downtime, network outages, or unauthorized third-party interference.
